These Terms of Use govern your access to and use of the Tychefy platform (the “Service”). By accessing and/or using the Service, you confirm that you accept these Terms as well as the Privacy Policy. If you do not agree, you must refrain from using the Service.
1. Nature of the Service and character of outputs
The Service provides tools for organising, ranking, and generating shortlists/recommendations for numerical selections. Outputs are probabilistic, based on historical data and algorithmic/statistical methods, and are provided solely for informational and assistive purposes.
2. Express disclaimer of prediction and warranties
- Tychefy does not predict draw results and provides no warranty (express or implied) as to success, likelihood of winning, hit rate, or any financial outcome.
- Terms such as “recommended”, “top-k”, “shortlist”, or “consensus” refer to internal ranking/organisation and do not constitute a promise, recommendation, or assurance.
- Lottery draws are random. The Service cannot influence, override, or substitute the randomness of any game.
3. No affiliation with gambling operators
Tychefy is not connected with, does not collaborate with, is not approved by, and is not sponsored by any gambling operator or public authority, unless expressly stated.
4. Exclusion and limitation of liability
To the maximum extent permitted by applicable law, you use the Service at your sole risk. Tychefy and its partners/providers shall not be liable for any direct or indirect damages, losses, loss of profits, costs of participation, or any consequence arising from use of the Service or from decisions taken in reliance on the outputs.
If, notwithstanding the above, liability is imposed, it is limited to the amount paid for your subscription in the twelve (12) months preceding the event giving rise to the claim (or zero in the case of free use).
Nothing in these Terms is intended to exclude or limit liability that cannot be excluded or limited under applicable law. Mandatory consumer rights, where applicable, are not affected.
5. “As is” and “as available”
The Service is provided “as is” and “as available”, without warranties of merchantability, fitness for a particular purpose, or uninterrupted operation.
6. Eligibility and responsible use
- Use of the Service by minors is prohibited. By accessing and/or using the Service, you represent and warrant that you are at least 18 years old.
- You remain solely responsible for compliance with applicable law and with the rules of gambling operators.
- Tychefy does not encourage excessive or problematic gambling activity and may restrict or terminate access in cases of misuse.
7. Accounts and security
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us promptly of any unauthorised use.
8. Subscriptions
Subscriptions provide access to features and outputs of the Service, not to guaranteed results. Payments, renewals, and cancellations may also be governed by the terms of the payment provider.
9. Intellectual property
Tychefy software, models, content, design, and marks are protected by intellectual/industrial property rights. Copying, redistribution, or commercial exploitation is prohibited without prior written permission.
10. Prohibited uses
- Violation of laws or operator rules.
- Bypassing access controls or abusing infrastructure.
- Reverse engineering, bulk scraping, or interference with the operation of the Service.
- Making misleading claims of “guaranteed predictions” or “certain profit”.
11. Changes and termination
Tychefy may modify the Service and/or these Terms, and may suspend or terminate access for security, compliance, or maintenance reasons. Continued use after changes constitutes acceptance.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Cyprus. The courts of the Republic of Cyprus shall have jurisdiction to resolve disputes.
If you are a consumer, any mandatory consumer protection provisions of the country of your habitual residence within the European Union continue to apply, to the extent that they cannot be contractually excluded.
